The legal framework governing claims of medical negligence is extensively documented within South African (SA) jurisprudence, with a predominant focus on the liability of medical practitioners. In contrast, the liability of pharmacists has received comparatively scant attention. This issue was recently highlighted by a case in which a woman from the Western Cape initiated legal action against Clicks, a leading health, beauty and wellness retailer and SA’s largest retail pharmacy chain, alleging that the provision of incorrect medication nearly cost her (...) life. At the time of writing, the case has yet to advance to trial. This article explores the legal and ethical dimensions of medical negligence attributed to pharmacists within the context of their professional duties. Additionally, it investigates how similar cases are adjudicated in foreign jurisdictions, with a specific focus on the US. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. We discuss the concepts of Weyl and Riemann frames in the context of metric theories of gravity and state the fact that they are completely equivalent as far as geodesic motion is concerned. We apply this result to conformally flat spacetimes and show that a new picture arises when a Riemannian spacetime is taken by means of geometrical gauge transformations into a Minkowskian flat spacetime. We find out that in the Weyl frame gravity is described by a scalar field. We (...) give some examples of how conformally flat spacetime configurations look when viewed from the standpoint of a Weyl frame. We show that in the non-relativistic and weak field regime the Weyl scalar field may be identified with the Newtonian gravitational potential. We suggest an equation for the scalar field by varying the Einstein-Hilbert action restricted to the class of conformally-flat spacetimes. We revisit Einstein and Fokker’s interpretation of Nordström scalar gravity theory and draw an analogy between this approach and the Weyl gauge formalism. We briefly take a look at two-dimensional gravity as viewed in the Weyl frame and address the question of quantizing a conformally flat spacetime by going to the Weyl frame. (shrink)

B.K.Matilal, and earlier J.F.Staal, have suggested a reading of the `Nyaya five limb schema' (also sometimes referred to as the Indian Schema or Hindu Syllogism) from Gotama's Nyaya-Sutra in terms of a binary occurrence relation. In this paper we provide a rational justification of a version of this reading as Analogical Reasoning within the framework of Polyadic Pure Inductive Logic.

The question of meaning entered sociology from the beginning. It is at issue with Marx’s theory of alienation and Weber’s method Verstehen. It was also at issue in the theoretical conflicts of naturalistic and positivistic with Marxist and verstehen-oriented methodologists. This would suggest that the perennial problem about what ‘sociology’ is or might be is at root about what ‘meaning’ is or might be.

Michael Allen's latest work on the profoundly influential Florentine thinker of the fifteenth century, Marsilio Ficino, will be welcomed by philosophers, literary scholars, and historians of the Renaissance, as well as by classicists. Ficino was responsible for inaugurating, shaping, and disseminating the wide-ranging philosophico-cultural movement known as Renaissance Platonism, and his views on the _Sophist_, which he saw as Plato's preeminent ontological dialogue, are of signal interest. Whatever one thinks of Heidegger's philosophy, he is one of the most incisive philosophic commentators of our time. He is frequently at his best and is most lucid in his close examinations of other philosophers. The introduction to Hegel's Phenomenology of Spirit has been overshadowed by the much more famous preface. In his paragraph-by-paragraph analysis, Heidegger reveals how much we learn from this introduction about Hegel's conception of knowledge, philosophy, and experience. At the same time that Heidegger illuminates Hegel's text, (...) he also reveals the direction of his own thought. Although Marcuse has been lavishly praised and severely condemned, he has been almost totally neglected by academic philosophers. One would have thought that MacIntyre was the ideal philosopher to write an intelligent critique of Marcuse. MacIntyre's own interests in Freud, Marx, and social theory center about the issues that have preoccupied Marcuse. Despite the claim to present Marcuse's views and then to criticize them, MacIntyre has written a stinging polemic. Marcuse is charged with being mistaken in all his key positions. (...) He fails to understand Hegel, Marx, Freud. His account of the ills of contemporary technological society is misguided. His positive program is contemptuous and dangerous. He is guilty of furthering the corruption of our language. Typical of MacIntyre's prose is his final sentence, "The philosophy of the Young Hegelians, fragments of Marxism and revised chunks of Freud's metapsychology: out of these materials Marcuse has produced a theory that, like so many of its predecessors, invokes the great names of freedom and reason while betraying their substance at every important point." On the basis of MacIntyre's reading of Marcuse it is hard to imagine that he is anything more than a bungling idiot. There is plenty to criticize in Marcuse, but MacIntyre's polemic backfires. The best and most effective critique is based on understanding, but despite appearances there is little attempt here to take Marcuse seriously. This is a pity because both Marcuse's thought and MacIntyre's important criticisms tend to get lost in all this lively prose.--R. J. B. (shrink)

It is a shame that this volume which was started a decade ago should have been so long in preparation. The result is that many of the critical papers have been superseded by more recent investigations. Nevertheless, there are a number of respects in which this is an extremely valuable book. It contains Carnap's autobiography, written in the direct and careful style that is so characteristic of his work. Carnap also patiently and systematically answers the objections raised by his critics. (...) And there is an invaluable annotated bibliography of his writings. But the dominant impression of the volume as a whole is that of summing up the contribution and limitations of one of the twentieth-century's most important and influential philosophers.—R. J. B. It is generally believed that the uncertainty relation Δq Δp≥1/2ħ, where Δq and Δp are standard deviations, is the precise mathematical expression of the uncertainty principle for position and momentum in quantum mechanics. We show that actually it is not possible to derive from this relation two central claims of the uncertainty principle, namely, the impossibility of an arbitrarily sharp specification of both position and momentum (as in the single-slit diffraction experiment), and the impossibility of the determination of the path (...) of a particle in an interference experiment (such as the double-slit experiment). J. B. Schneewind's "The Invention of Autonomy" has been hailed as a major interpretation of modern moral thought. Schneewind's narrative, however, elides several serious interpretive issues, particularly in the transition from late medieval to early modern thought. This results in potentially distorted accounts of Thomas Aquinas, Hugo Grotius, and G. W. Leibniz. Since these thinkers play a crucial role in Schneewind's argument, uncertainty over their work calls into question at least some of Schneewind's larger agenda for the history of ethics.
